California Attorney General: Trump Violated The Posse Comitatus Act In Deploying National Guard And Marines In Los Angeles

Wednesday, California Attorney General Rob Bonta spoke after the conclusion of a three-day trial into a lawsuit filed against Donald Trump for his allegedly unlawful federalizing and deployment of California National Guard troops and Marines for domestic law enforcement purposes, in Los Angeles.

“Before the trial began, I issued a statement expressing confidence that the evidence would show that the Trump Administration violated the Posse Comitatus Act. Now that the trial has ended, I remain confident. Our legal team did a great job,” said Attorney General Bonta. “We asked the court to grant a permanent injunction to stop the Administration from using the military for domestic law enforcement and maintaining a standing army in Southern California. We made a compelling case — backed by facts and specifics — and we look forward to getting a decision in the near future.” 

Under the Posse Comitatus Act, using the military for civilian law enforcement is generally prohibited.

During the three-day trial, the State of California said that in federalizing the California National Guard, and the Marines, Trump violated three provision of the Posse Comitatus Act: 

(1) Under the Trump Administration’s command, federalized National Guard members have subjected civilians to the exercise of proscriptive military power.  

(2) The Trump Administration is making direct, active use of military personnel to execute the law, including through the provision of armed perimeter support and blockades, apprehension and detention of civilians, and — in the weeks following the June mobilization orders — participating in an estimated three out of every four immigration raids in Los Angeles and surrounding areas. 

(3) The Trump Administration’s use of military personnel clearly pervades the activities of civilian law enforcement. 

Attorney General Bonta says he remains committed to pushing back on Donald Trump and to holding him accountable for his unlawful authoritarian overreach in infringing on the rights of Californians.

In a Democracy Now interview, Bonta stated that besides himself, many other Democratic AG’s are committed to fighting Trump in the courts.

“The Democratic AGs, and here in California, through the work of my office, we are fighting back, and we are getting things done. We are making a difference. We have sued the president here in California 37 times in 29 weeks — more than once a week — to great success. Out of the 20 times when an order has been issued by a court, we’ve won 90% of the time, secured 18 different orders. We prevented $168 billion from being improperly and unconstitutionally withheld from the people of California, a return on investment of $1 of investment leading to $33,600 in return in protected federal funding.

“So, it’s important to tell the story of the Democratic attorneys general fighting back unapologetically, resolutely, pushing back against a president who is blatantly, brazenly, consistently and frequently breaking the law and trampling over the Constitution, and tell the story that we are winning in court and stopping him and blocking him. When we push back and fight and show courage and go to court, we win. And so, that’s an important story to tell. I’m very proud of — to work with all my Democratic attorney general colleagues across this nation to fight back against a repeat offender, lawless and law-breaking president.”
