New York Attorney General: We Are Investigating Police Killing Of 19-Year-Old On Long Island

NEW YORK – The New York Attorney General’s Office of Special Investigation (OSI) has opened an investigation into the death of David Clements, who died on February 2, 2024 after an encounter with the Nassau County Police Department (NCPD) in Massapequa, New York. 

On the evening of February 2, NCPD officers responded to a 911 call reporting a suicidal person armed with a gun at a residence on Stone Boulevard in Massapequa [Long Island]. Upon arrival, officers encountered Mr. Clements in front of the residence, allegedly holding a handgun. During the encounter, Mr. Clements allegedly pointed the gun at the officers. An officer fired his service weapon at Mr. Clements three times.

Mr. Clements was pronounced dead at the scene. Officers recovered two BB guns and one handgun at the scene.

Pursuant to New York State Executive Law Section 70-b, OSI assesses every incident reported to it where a police officer or a peace officer, including a corrections officer, may have caused the death of a person by an act or omission. Under the law, the officer may be on-duty or off-duty, and the decedent may be armed or unarmed. Also, the decedent may or may not be in custody or incarcerated. If OSI’s assessment indicates an officer may have caused the death, OSI proceeds to conduct a full investigation of the incident.
